Fitness for use (agibilità): the certificate that opens the building to use
Summary
TAV. 00Not a title to build but to use: the certified report of fitness for use (art. 24 of D.P.R. 380/2001) attests that the completed building has the conditions of safety, hygiene, health and energy saving to be used. Since 2016 it is a sworn report, with control coming afterwards.
Scope of application
TAV. 01It is required for new buildings and for works affecting the safety, hygiene, health or energy saving of the building and its systems. It is filed at the one-stop desk with the customary attachments. The rules may be supplemented by regional laws.
In depth
TAV. ANot a title to build, but to use
Fitness for use closes the circle. All the other titles (permit, SCIA, CILA, free building) authorise building; agibilità certifies that what has been built can be used. It is the threshold between the constructed building and the usable, inhabitable one. Governed by art. 24 of D.P.R. 380/2001.
What it certifies
The existence of the conditions of safety, hygiene, health and energy saving of the building and its systems, assessed under current rules. It comes with the customary documents: structural testing, systems' conformity, the energy performance certificate (EPC) and cadastral registration.
| Requirement | In brief |
|---|---|
| Safety | tested structures, compliant systems |
| Hygiene and health | sanitary conditions of the spaces |
| Energy saving | performance of the building and systems (EPC) |
| Cadastral consistency | update and correspondence to the land registry |
How and when
The report is filed at the one-stop desk, as a rule within fifteen days of the end of works, with the sworn statement and the attachments. As with the SCIA, use may begin and the authority's control comes afterwards. Failure to file is sanctioned.
- 01End of worksEnd of works and gathering of the documents (testing, conformity, EPC, cadastre).
- 02Sworn statementThe professional swears the existence of the requirements.
- 03ReportThe certified report of fitness for use is filed at the one-stop desk.
- 04UseThe property may be used; control comes afterwards.
Why it matters
Without fitness for use a building may be finished but not lawfully usable, with effects on marketability and contracts. It is the document that turns a structure into a space one can live or work in: the act that gives meaning to all the titles that preceded it.
Key points
TAV. K- It does not authorise building: it certifies that the building can be used (art. 24 D.P.R. 380/2001).
- Since 2016 it is a certified report of fitness for use (SCA), sworn by a professional, no longer a Municipality certificate.
- It attests safety, hygiene/health and energy saving of the building and its systems.
- It is filed at the one-stop desk, as a rule within 15 days of the end of works.
- It closes the building cycle: without it, the finished property is not lawfully usable.
Frequently asked questions
TAV. QIs agibilità a title to build?
No: the other titles authorise the works, agibilità certifies that the result can be used. It closes the cycle.
Who issues agibilità today?
Since 2016 it is no longer a Municipality certificate: it is a certified report (SCA) sworn by a professional and filed by the interested party, with control afterwards.
When must it be filed?
As a rule within fifteen days of the end of works, at the one-stop desk, with the attachments (testing, systems' conformity, EPC, cadastral registration).
What do I risk without agibilità?
A fine and, above all, the impossibility of lawfully using the property, with effects on sales, leases and mortgages.
Is it always needed?
It is required for new buildings and for works affecting safety, hygiene, health or energy saving; not for works that do not touch these requirements.
