Not a title to build but to use: the certified report of fitness for use (art. 24 of D.P.R. 380/2001) attests that the completed building has the conditions of safety, hygiene, health and energy saving to be used. Since 2016 it is a sworn report, with control coming afterwards.

It is required for new buildings and for works affecting the safety, hygiene, health or energy saving of the building and its systems. It is filed at the one-stop desk with the customary attachments. The rules may be supplemented by regional laws.

Not a title to build, but to use

Fitness for use closes the circle. All the other titles (permit, SCIA, CILA, free building) authorise building; agibilità certifies that what has been built can be used. It is the threshold between the constructed building and the usable, inhabitable one. Governed by art. 24 of D.P.R. 380/2001.

NOTE

Since 2016 it is no longer a certificate issued by the Municipality but a certified report of fitness for use (SCA), sworn by a professional: the same logic as the SCIA, applied to the end of works.

What it certifies

The existence of the conditions of safety, hygiene, health and energy saving of the building and its systems, assessed under current rules. It comes with the customary documents: structural testing, systems' conformity, the energy performance certificate (EPC) and cadastral registration.

How and when

The report is filed at the one-stop desk, as a rule within fifteen days of the end of works, with the sworn statement and the attachments. As with the SCIA, use may begin and the authority's control comes afterwards. Failure to file is sanctioned.

CAUTION

Without fitness for use a finished building is not lawfully usable: the lack affects sales, leases and mortgages, beyond the fine. It is not a formal closing step, but the condition that makes the building truly usable.

Without fitness for use a building may be finished but not lawfully usable, with effects on marketability and contracts. It is the document that turns a structure into a space one can live or work in: the act that gives meaning to all the titles that preceded it.
